Welcome to Watts 1874. These General Conditions of Sale govern the terms and conditions under which Watts 1874 provides its high-end fabrics, printed wallpapers, and related products to its customers. By placing an order with Watts 1874, you, as the buyer, agree to be bound by these conditions, which are intended to ensure clarity, transparency, and fairness in our business dealings.
At Watts 1874, we pride ourselves on delivering luxury products with the highest standards of craftsmanship and service. To maintain these standards, we ask that our clients carefully review these conditions before making any purchase. These terms outline important aspects of our sales process, including pricing, payment terms, delivery, returns, warranties, and the handling of disputes.
1. Product Properties
Due to the nature of our products, certain characteristics , such as repeats, widths, and textures, may vary slightly from batch to batch. This section outlines important details about the unique properties of such products, including specific materials like velvets and their inherent sensitivities.
1.1. Repeats and Widths
All repeats and widths mentioned are indicative and may vary slightly between production batches. If a design is sold strictly by repeat, please specify the number of repeats when placing the order.
1.2. Velvets
Velvet fabrics may show signs of crushing or shine during transport despite our careful packaging. This should not be considered a defect. After upholstering, slight variations may appear but will normalize over time.
1.3. Viscose, Cupro, or Silk Velvets
These materials are prone to crushing, especially under pressure or perspiration, and any contact with water will permanently alter their appearance. This is an inherent characteristic of the fabric, and professional clients must inform their customers accordingly.
1.4. Hygrometric Variations
Fabric dimensions can change by 3-5% due to environmental humidity. Such variations, including after dry cleaning, are considered normal.
1.5. Flame Retardancy Treatment
Different countries have specific regulations regarding flame retardancy (FR). It is the customer’s responsibility to verify these requirements before ordering. FR treatments are temporary and can alter fabric colors and texture. We do not recommend FR treatments for upholstery. Many of our designs can be woven in TREVIRA CS or fire-retardant polyester on request (minimum order quantity is 120 m). Not all fabrics can be treated. Watts 1874 will not be liable for any problem arising from treatments.
2. ORDERS, PAYMENTS AND SHIPPING
2.1. Pricing and Minimum Orders
All prices are exclusive of VAT, shipping and duties fees. Minimum orders vary depending on stock availability or custom orders. Prices are subject to change without prior notice, and international customers should be aware that additional customs duties or local taxes may apply upon importation.
2.2. Order Confirmation
All orders must be confirmed in writing. We are not liable for errors due to verbal orders or unconfirmed requests.
2.3. Payment Terms
Payment is required in advance. For customers with an agreed credit limit, payment must be made within thirty (30) days following the invoice date. Late payments will automatically incur a £40 indemnity fee per unpaid invoice, and interest will be charged at 15% annually with a minimum fee of £155. Orders may be suspended or canceled, and credit lines may be withdrawn in case of unpaid invoices.
2.4. Delivery and Shipping
We dispatch goods via our preferred carrier with standard delivery. Express delivery is available upon request at an additional cost. Delivery dates are estimates, and we are not liable for delays. International customers are responsible for customs clearance, duties, and any additional taxes that may be imposed by the destination country. Unless otherwise expressly agreed, international shipment of products are under DAP (Incoterms 2020).
2.5. Cancellation of Orders
Cancellations may result in a charge of up to 50% of the order value. Custom orders cannot be canceled once production has begun.
3. RETURNS AND EXCHANGES
3.1. Returns
Ready-made goods may be returned within 14 days of dispatch, provided they are in perfect, uncut condition and in their original packaging. A 20% restocking fee will be applied. The customer must obtain written approval from Watts 1874 before returning any goods, and all shipping costs will be borne by the customer, including any international return shipping costs.
3.2. Non-Returnable Goods
Custom-produced items, or those treated with special finishes, cannot be returned. Open rolls of wallpaper and cut fabrics are not eligible for return unless defective.
4. RESERVATION OF TITLE
Ownership of the goods remains with Watts 1874 until full payment has been received. However, the risk of loss or damage to the goods passes to the buyer upon delivery. International customers assume full responsibility for the goods once they have cleared customs in their country.
5. PURCHASES AND RIGHT OF WITHDRAWAL
5.1. Finality of Purchases
All purchases are final unless covered by the legal right of withdrawal under UK consumer law. This right allows consumers 14 days to retract their purchase, provided the goods are not custom-made or altered.
5.2. Exercising the Right of Withdrawal
To exercise this right, customers must (i) be consumers as defined under UK law and (ii) notify us within the 14-day period. Returned goods must be in original, unused condition. Return shipping costs will be borne by the customer, including international returns, and any customs or duties will not be refunded.
6. INTERNATIONAL CUSTOMERS
6.1. Customs and Import Taxes
International customers are responsible for paying any customs duties, VAT, or local taxes that may be imposed upon importation. These costs are not included in our prices.
6.2. Compliance with Local Regulations
It is the responsibility of international customers to ensure that the products ordered comply with local regulations, including any restrictions on the import of textile goods.
7. GUARANTEE AND LIABILITY
7.1. Manufacturing Defects
All goods are guaranteed against manufacturing defects for one year from the invoice date, assuming normal use and proper care. Any claim must be made within this period.
7.2. Inspection
Customers must inspect goods within 10 days of receipt (within 24 hours for velvet fabrics). Any issues, including incorrect quantities, must be reported immediately. We cannot accept claims for goods that have been cut or made up.
7.3. Color Variations
We cannot guarantee an exact match between sample colors and final products. To ensure color consistency, please request a stock cutting and reserve.
7.4. Dimensional Stability and Wear
Products may show variations in stability due to environmental conditions. Normal wear and tear over time is not covered by this guarantee. We guarantee against premature wear under standard conditions of use.
7.5. UV and Light Exposure
All products are designed to withstand typical exposure to light, but colors may fade over time. Direct exposure to ultraviolet or infrared light should be minimized to preserve longevity.
7.6. Professional Cleaning
Fabrics and wallpapers should be professionally cleaned. Certain treatments, such as stain repellents, require specific care instructions that should be communicated to the cleaning service.
7.7. Wallpaper Installation
Before hanging wallpaper, check all rolls for damage and ensure they are from the same batch. Follow all hanging instructions and recommended adhesives. Claims will not be accepted for improper installation.
7.8. Exclusion of liability
Watts 1874 shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of its products or late delivery, including but not limited to loss of profits, business interruption, or any other commercial damages or losses, even if Watts 1874 has been advised of the possibility of such damages. Furthermore, Watts 1874 assumes no responsibility for the improper use, handling, installation, or maintenance of its products by the customer or any third party, including but not limited to treatments applied to fabrics, failure to follow care instructions, or installation errors. Any claims related to the quality or performance of products must be made within the warranty period, as outlined in our General Conditions of Sale, and are subject to the limitations specified therein. Watts 1874’s aggregate maximum liability under any order shall in all events, be capped at the value of said order.
8. Force Majeure
Watts 1874 shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, natural disasters, pandemic-related disruptions, or other causes that could not have been anticipated or avoided by reasonable measures.
9. Confidentiality
9.1. Confidential Information
The buyer agrees to treat all non-public, confidential, or proprietary information disclosed by Watts 1874, including, but not limited to, product designs, specifications, prices, trade secrets, and other business operations, as strictly confidential. This obligation remains in force both during the term of the business relationship and after its termination.
9.2. Use of Confidential Information
The buyer shall not use any confidential information for any purpose other than to fulfill its obligations or enforce its rights under this agreement, nor disclose it to any third party without the prior written consent of Watts 1874, except where required by law.
10. Intellectual Property and Trademarks
10.1. Ownership of Designs and Intellectual Property
All designs, patterns, and products created by Watts 1874, including trademarks, copyrights, and other intellectual property, remain the exclusive property of Watts 1874. The sale of any product by Watts 1874 does not transfer any intellectual property rights to the buyer.
10.2. Restrictions on Use
The buyer is prohibited from reproducing, copying, or distributing any of Watts 1874’s designs, patterns, or products without prior written permission. Unauthorized use of Watts 1874’s intellectual property, including but not limited to brand names, logos, designs, and patterns, is strictly prohibited and may result in legal action.
10.3. Third-Party Infringement
Watts 1874 shall not be held liable for any claims arising from the infringement of third-party intellectual property rights by the buyer’s use of Watts 1874’s products, unless the claim arises from a design that was exclusively created by Watts 1874.
11. Compliance with Trade Sanctions and Export Controls
11.1. Trade Sanctions
The buyer represents and warrants that it is not, and will not directly or indirectly engage in transactions with, any individual, entity, or country subject to sanctions, embargoes, or other restrictive measures imposed by the United Nations, the European Union, the United Kingdom, the United States, or any other applicable jurisdiction.
11.2. Export Controls
The buyer acknowledges that certain products sold by Watts 1874 may be subject to export controls under UK, EU, U.S., or other applicable laws. The buyer agrees to comply with all applicable export control laws and not to export, re-export, or transfer the products in violation of such laws.
11.3. Prohibited Transactions
The buyer shall not sell, distribute, or otherwise transfer any products purchased from Watts 1874 to any person or entity (i) located in, or that is a national or resident of, any country subject to comprehensive trade sanctions or embargoes (ii) or that is listed on any government’s sanctions or restricted parties list, including the UK’s Office of Financial Sanctions Implementation (OFSI) list, the U.S. Treasury Department's Specially Designated Nationals (SDN) list, or any equivalent lists of other jurisdictions.
11.4. Indemnification
The buyer agrees to indemnify and hold harmless Watts 1874 from any liability, loss, or damage, including legal costs, arising from any breach of this clause by the buyer.
12. Protection of Personal Information
12.1. Compliance with Data Protection Laws
Watts 1874 is committed to protecting the privacy and personal data of its customers. We will process all personal data, including customer contact information, in accordance with applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR) and the UK Data Protection Act.
12.2. Use of Customer Information
Customer contact information and personal data will be used solely for the purposes of fulfilling orders, providing customer support, and for any other legitimate business purposes as outlined in our Privacy Policy. We will not disclose customer data to third parties unless required to do so by law or with the explicit consent of the customer.
12.3. Data Security
Watts 1874 implements appropriate technical and organizational measures to ensure the security and confidentiality of customer data and to protect it from unauthorized access, disclosure, alteration, or destruction.
12.4. Customer Rights

13. DISPUTES
All transactions are governed by English law, and any disputes will be resolved under the jurisdiction of the English courts. International customers agree that any legal disputes will be resolved in English courts, unless prohibited by local consumer protection laws.
